No Smoking One Metre From Service Bars/Counters

 

Smoking is not be permitted within one metre of service areas (such as bars and other counters) in most licensed hospitality venues.

 

 

What will this do?

 

This law is aimed at increasing the comfort of employees and increasing the public’s awareness of the negative effect that passive smoking has upon staff. A similar rule has been successfully implemented in the Australian Capital Territory and voluntarily in New South Wales.

 

 

What is meant by ‘one metre back’?

 

No smoking one metre back from all service areas means that smoking will not be permitted within one metre of the outside edge of all service areas (including bar counters).  Smoking is also banned over the top of and behind the bar counter. 

 

Are there any areas where you don’t need to establish the one-metre ban?

 

A bar room does not have to implement the one-metre ban if the bar room is very narrow (that is, if more than 75% of the drinks counter is within three metres of the opposite wall).

 

However, if there is more than one separate bar area in the venue, you need to implement the following restriction in the narrow bar room:  At least 25% of the bar room and drinks counter must be designated non-smoking.

REMEMBER: 

If the narrow bar room is the only bar room in the venue then you are required to: Designate at least 50% of its floor space as non-smoking.

 

 

How do I comply?

 

The Department of Health will help you meet these new requirements by providing free:

  • Signage – bar tops, stickers and posters.
  • Information pamphlets for patrons.
